An NPR interview with the owner of a gun store that sold the Las Vegas shooter some guns said that he not only passed all required background checks, he also passed their "smell test" meaning that he didn't seem sketchy to them.

Two points on that:  Obviously there is no way to predict which people who buy guns will use them for legitimate self defense and which will use them for evil purposes.  We do know that well over 99.9999% of all guns sold never kill a human being for any reason.  So the question is do we limit the rights of all for the sake of a tiny minority of wrong-doers who will likely find ways around any laws we pass anyway.  To a libertarian or anyone claiming to be a libertarian, the answer is clear.

Second point:  Are gun stores allowed to have a subjective "smell test" for customers to buy guns?  It sounds like discrimination to me, especially if a racial or religious minority ever were to be denied a purchase because the owner found him or her "sketchy."   So should such a test be allowed?

In a libertarian system there would be no such authority.  In our current system, I could easily imagine three swarthy, bearded, turban wearing, Arabic muttering men claiming discrimination because a gun store turned them down.

That's where the government comes in handy. The FBI and the BATFE etc. can investigate the men in question and find out the truth.

Licensed firearm dealers can lose their licenses and be heavily fined and even jailed for selling to people who are prohibited from buying firearms. They are justified in being cautious. The law requires them to discriminate.

No libertarian gun store owner would turn those Arabic muttering guys down. And fwiw, no libertarian store owner would turn them down if they wanted to buy high explosives. If I was a gun store owner I would check southerns hillbillies twice before giving them anything the could hurt themselves or others with. Inevitably that's the kind of Americans who turn out to be shooters.

The picture they keep showing of the shooter is a picture of a dead guy. They didn't try very hard to hide it so that could have some bearing on the story if it ever comes out.

He must have put the gun under his chin or in his mouth so that a flattering picture could be taken.

Sounds like what happened with "The Flying Imams" and then they won their lawsuit against U.S. Airways.

If they want to uphold their libertarian principles then they'll have to lose their licences. Too bad. They can sell their guns at gun shows where Osama Bin Laden could even get a rocket launcher.

And it also turns out that the shooter had 12 legal machine guns. That's the reason why he was able to do such a thorough job on the crowd that was about 400 yards away.

But they were legal and the Republicans are already making claims that they shouldn't be outlawed. It's a second mendmunt rits thing. guns r wots gud.
