Jeff, the Federal Trade Commission or the Consumers' Products Safety Commission or the Federal Communications Commission could probably handle applying Amendment IX to media services or media products.

Violent video games would be relatively harmless if guns were banned. Cowards don't like using knives all that much.

Jeff, the FTC, CPSC, and the FCC can decide what media products and media services deserve to be interpreted as "criminal" and therefore outlawed.

What you said here-

is a description of lawmaking.

Deciding what is criminal is making statute law.

Only Congress can legally do it at that level, and it all must be within the Constitution, with better justification than "necessary and proper"...
