Tort Law is an odd thing... 

Most people are oblivious to it until they find themself in a situation when suddenly, it becomes highly relevant.

It really pays to have a family member knowledgeable in Tort Law!

What do you mean by "overt"?

From what you constantly say, you believe that the only time rights are actually violated is if there is a specific law enacted by the government making a specific action illegal, so that is probably what you mean by "overt violation of rights" when a statute law has been violated.

That is simply not true. The Common Law operates on basic principles, one of which is that everyone has a right not to have their person or property damaged or diminished by others, which often conflicts with everyone's right to act freely in their own interests.

Obviously conflicts will arise when two individuals both believe that their rights or property are being diminished or damaged by the other.

The Common Law has proved to be the best way to solve those sorts of differences of opinions.

Mostly all you have to do Chief is respect the rights and property of others and try to think before you do something that will give someone cause for complaint.

But there are always situations when torts happen.

Last 4th of July, some neighbors were shooting off semi-professional aerial fireworks - the kind that are launched from mortars. (They've done this every July 4th for the past 11 years)

We were out of town on the 4th, but when we returned home, I found a (piece of) pyrotechnic shell that had landed in the track of a large double-paned sliding glass door.  The track/frame is vinyl, so the smouldering shell melted the vinyl track.  The door was inoperable.  The whole thing had to be replaced.  $1440.

long story short - we had a witness, so I told Mr. Fireworx he had a choice - pay for the window replacement or take his chances in Court.  He agreed to pay.

He's paid most of it... He still owes us $250.

I expect Mr. Fireworx will be more careful on this upcoming 4th.

That's when you complain. It's best to talk first to the person you think has offended your rights.

Often they will say, "Sorry, I didn't know it was bothering anyone, and stop.

I backed over a mailbox on a post once, and when I went and knocked on the door to offer to fix it or pay for it, they forgave me.

We live fairly close to the ocean. The salt air corrodes aluminum within a couple years. 

Aside from the fireworks mishap, the vinyl has held up very well - never needs painting  -  it has UV inhibitors baked into it, so it never cracks or warps from sunlight.
