Harvard Law Professor Goes Bonkers - Abolish The Supreme Court!

LOL.

We knew it would happen eventually.  Down the rabbit-hole they go...

The Left fears that Roe vs Wade will be overturned, and Planned Parenthood will be de-funded.  So what's the logical solution?

Abolish the only Court in the land which has the power to overturn it, of course!   Grin    Grin

First and foremost, just because you are worried about an outcome, does not mean that you should try to demolish a cornerstone of the American judicial system.  This policy applies to all sides of the equation on every issue.  One can put forward an argument for why there is a better system than the supreme court, but we do this at our peril.  The system we have is far from perfect, yet there must be solid evidence for a better system to be put in place.  One shouldn’t forget that the American constitution should be touched with the utmost care and respect.  This document has protected the people for many years from totalitarianism and fascist rule.  Also, life does not always go the way that you want it to.  Don’t forget, your opinion may be entirely wrong, so stay on the side of liberty.

They don't mention it, but they are talking about amending the Constitution to once again make our system of government even more "democratic".

Of course if it gets "democratic" enough, we will become a Democratic Socialist country...

They identify problems caused by the S.Ct. being at times a political tool (in the "modern era"), but want to remove the tools potential power to say no to socialist programs, which will eliminate the Court as a political tool, but allow politicians to have even more power than they have already usurped.

It's a logical progression- Politicize the Court as FDR did, then enact lots of "progressive" socialist programs and wealth transfers and taxation and regulation virtually without limits, then cry that the Court, from time to time, stands in the way of more socialism and call for it to be abolished.

No, this is the idea of Mark Tushnet, a neo-liberal Harvard Law professor.

The Donald wants to KEEP the Supreme Court.

When Justice Ruth passes on, another seat becomes available.  Trump would be tickled to nominate a 3rd Justice, I'm sure.   Smiley

I'm never confident that I know what Trump really wants.

Neo-Liberal as opposed to a Classic Liberal.  I just wanted to make the distinction.

Professor Tushnet suggests abolishing the Supreme Court so that Roe v Wade can never be challenged.

It's a clever idea - I'll give him that.   

It will never happen, though.

We really can't be sure, but that's not important, IMO.
