You are advocating that the federal government control schools while pretending that you want local controllers to control them.

No, I want the course of study and the teachers in local schools to be controlled locally, primarily by the local parents.

I don't want local governments to be permitted to pass racially discriminatory laws.

It's unconstitutional actions by local governments that I want the federal government to control by prohibiting them.

You've found an out for racists? School boards act as agents of the state government, from which their authority is derived. I don't think they can get away with racially segregating their schools by saying it's "just policy not law". Agents of governments make policy under the existing laws.

Take the state out of education, and school board's authority would derive from local governments. If a local school board segregated it's schools by race, the local government would be responsible, and the federal government would be required to tell the local government that it's agents were violating the Constitution and must stop.

Haven't the courts already gotten involved in that sort of thing? It's a stretch of equal protection of the law in my mind, sort of like saying that if a school spends more money teaching chemistry than teaching English (because labs and lab equipment cost money and aren't needed to teach English) that students who don't take chemistry are being denied equal protection.

The way I see it, if all the students are being offered physical education, everything is fine. If there is a disparity in what is being spent on boys volleyball and girls volleyball, maybe I'd be convinced there was some sort of sex discrimination going on.
