Would this be theft????? Hypothetical Scenario

A guy needs a dollar bill for the coke machine but he only has a fiver.  He passes by a tip jar and sees many dollar bills.  He puts in his fiver and takes out five ones.  The guy who gets tips isn’t looking.

Is that theft?

Why or why not?

It's theft. 

Mr. Cokedrinker made a trade without permission.

What if, instead of a $5 bill, he had left 500 pennies?  

Or a bag full of empty aluminum cans ($5 worth of aluminum)?

I would be pissed.   Angry

Fair point, but the scenario was putting in a $5 and taking 5 $1 from a jar full of ones.  You can always make a living going to hypothetical extremes.  Opposition makes a living doing that.

Of course you should ask, but the question was just if it's theft

I can imagine several non-extreme scenarios in which the tip jar owner would prefer ones to a five.  He might want ones for the coke machine himself.  He might be going to a strip club after work.  He might plan on giving his kids ones as allowance when he gets home. 

Either way, taking them without permission is not the same as a voluntary trade even if he gives what he thinks is a fair value.

But taking something of value without the owner's consent is, by definition, theft.
