This is not how rights actually work, however, and I understand that. I agree with Jeff that I don't have rights in actuality, because they're not agreements, nor are they reciprocal.

Aren't you always saying that libertarians are trying to limit rights?

In a justice market, the demand comes from victims, potential victims, or victims' agents. The supply comes from arbitrators, security markets, insurers, subrogators, investigators, &c. A free subrogation market shifts costs from the victims to the tortfeasors.

That's all swell if you can afford to buy the justice and/or if the tortfeasor has assets.

What if I'm poor and I get assaulted and raped by a poor person?

I know, that's a crime rather than a tort, but what if I'm poor and my poor neighbor accidentally burns down my tool shed and destroys the tools I need to scratch out my meager living? (No, sorry, I couldn't afford to carry insurance on my tool shed and tools. I can barely afford the mandated auto insurance and the liability insurance I carry to protect me from work related lawsuits... I was lucky my house didn't burn down too, since I can't afford insurance on it either.)

It's a crime against the State
It's a tort against you
