Ohio Appeals Court Rules Chalking Tires Is Unconstitutional

The 6th U.S. Circuit Court of Appeals in Cincinnati decided chalking tires constitutes an unreasonable search, which is a violation of the 4th Amendment of the U.S. Constitution.

The Court reasoned that chalking is similar to a GPS tracker on a vehicle, which the Supreme Court ruled can not be done without a warrant.

U.S. Circuit Judge Bernice Bouie Donald wrote:

"The city commences its search on vehicles that are parked legally, without probable cause or even so much as 'individualized suspicion of wrongdoing' ... the touchstone of the reasonable standard."

I welcome any reduction in the powers of gov't.  Smiley

Governments will always devise ways to deprive an honest man of his money or property, and claim that it's legal.

Then use chalk to mark the sidewalk at the exact position of the tire. Colour code it for times of day as needed.

You're lucky the government is stupid.

This moral relativism of yours is exactly what lets government take this freedom, then that freedom, until we have lost them all.

+1

The downside is that while we always outsmart them, they unfortunately don't accept that and just keep getting more and more beligerant thinking that will fix what didn't work.  It still doesn't work, but it causes more and more economic inefficiency.

Like moving money to avoid taxes and lower rates.  It's work, but produces no economic productivity
