Problems With Red Flag Laws And The 4th Amendment

A Red Flag law is a gun violence prevention law that empowers police or family members to petition a State Court to order the confiscation of firearms from a person who "may present a danger to others or themselves".

A judge makes the determination to issue the order based on statements and actions made by the gun owner in question.

There are some fancy names for Red Flag laws.  Here are a few:

• "Extreme Risk Protection Orders" (ERPO)
• "Risk Protection Orders" 
• "Gun Violence Restraining Orders"
• "risk warrants" 
• "Proceedings for the Seizure and Retention of a Firearm"

The thing is, all of these Red Flag laws violate an individual's right to due process.   But then, so did the PATRIOT Act.  Nobody seemed to care about it, so why would anyone care if Red Flag Laws violate 4th Amendment (due process) rights?

There is a renewed demand for Red Flag laws. 

In the wake of last weekend's mass shootings in El Paso and Dayton, Trump has called for more Red Flag laws. It was a knee-jerk political response without any real thought, which is fairly typical of the president.

Wave goodbye to Constitutional rights.   Hey - they were nice while they lasted!

I don't think so. I think The Donald is in on the plan to tyrannize America for profit.

But the Red Flag laws will take away their guns.  How can they protect their right to re-build Afrofuture?  It is you white cavemen who overthrew them and stole their technology.  Deyz wuz kangs with space pyramids and lasers and shieet.

But Red Flag laws wouldn't apply to Africans wielding AK-47s. 

Machetes are banned in London, but we can still buy them in California.

In fact, we can buy machetes at the local Home Depot store.   For some unknown reason, they're located in the "Lawn & Garden" section of the store.

Do they think we will use machetes to trim the bougainvilleas??    Undecided    Grin

They can be used to prune and trim light branches. I thought everybody knew that...

There are tools I like better for the job.

Anyway, you're telling me red flag laws won't help in Africa?

Can you think of anything that will?

Dems and republicans Congress critters conspire to pass new Gun-Control measures that will violate rights defined in Amendment II, and due-process Laws outlined in Amendment IV.

It wont be the first time Congress has passed Law that supersedes the US constitution.

The NRA issued the following warning to US Lawmakers:

“Someone could be stripped of their Second Amendment rights without due process, without being taken into custody for any criminal offense or without being required to undergo evaluation for treatment by a mental health professional.”

Lawmakers are willing to push Constitutional rights aside in favor of safety.  We can expect SCOTUS to look the other way.  They did with the PATRIOT Act of 2001.
